Terms and Conditions
1. Payment Terms
Services for the complete organization of a training camp are bindingly booked with a timely
deposit (see invoice) amounting to 30% of the total amount. Subsequently, the remaining payment
of 50% of the total amount and the final payment of 20% of the total amount must be
made according to the payment dates specified in the respective total invoice.
Catering services are bindingly booked with a simple confirmation via email. Payment must be
made in full within 14 days of invoicing.
2. Cancellation
If payments are not fully made before the start of the services, Havel Sports may cancel the
entire service. A full refund cannot be guaranteed, as cancellation fees from catering providers,
accommodation operators, and the host club will be passed on in full to the original service
recipient (with proof).
3. Deposit Terms
If the accommodation “Raumquartier” is booked, a damage deposit of €800.00 must be transferred
at least ten days before arrival to the following account: DE60 1207 0400 0058 1256 00
with the transfer reference: Deposit “Club Name.” Without the transferred deposit, the
“Raumquartier” will not be handed over. After the return of the “Raumquartier” without complaints,
the full deposit will be refunded within ten days.
4. Loss or Damage to Rental Items
The customer is responsible for the care of items in the accommodation from the day of arrival
until departure. In case of damage or loss caused by the guest club or attributable to its negligence,
particularly by its employees or athletes, the costs of replacement or repair will be
charged.
5. Complaints
Obvious defects can only be considered if the complaint is made immediately upon arrival.
6. Changes
Havel Sports reserves the right to make changes to the planned schedule. This applies to training times or specified meal times. However, the scope of services remains unchanged. If
services are omitted due to the fault of Havel Sports or subcontractors/suppliers engaged by
Havel Sports, the costs invoiced for such services will be refunded to the customer.
7. House Rules & Fire Safety
The customer is obliged to comply with the house rules and fire safety regulations of the respective
accommodation operator during the stay. In the event of a justified police intervention
caused by the customer after 10:00 PM in the “Raumquartier” accommodation, an additional
penalty of €2,000.00 will be imposed by the accommodation operator.
8. Catering / Meals
Havel Sports acts as an intermediary for catering services provided by local companies. The
respective supplier is responsible for the quality and compliance with hygiene standards in the
preparation of meals. Havel Sports assumes no liability in this regard.
9. Swimming Pool Area / Sports Halls
During the stay in the assigned sports facilities, the respective house rules apply. The instructions
of the on-site personnel must be followed without exception. The host club provides the
customer (unless otherwise agreed) with training materials and equipment (balls, caps). These
training materials and equipment must be handled with care, and damage must be avoided. If
materials or equipment are intentionally damaged, the costs will be charged by the host club.
10. Force Majeure
10.1 Definition:
Force majeure refers to unforeseeable, extraordinary events beyond the control of the contracting
parties that make the fulfillment of contractual obligations impossible or significantly
more difficult. This includes, but is not limited to, natural disasters, extreme weather conditions,
epidemics, pandemics, governmental orders, war, acts of terrorism, strikes, riots, or other similar
events.
10.2 Consequences for Contract Fulfillment:
a) If the fulfillment of contractual services becomes impossible due to force majeure, the obligations
of both parties are suspended for the duration of the force majeure.
b) Services or expenses already rendered (e.g., deposits, cancellation fees for third-party providers)
will be credited or refunded where possible. Havel Sports will strive to find a fair arrangement
for both parties.
10.3 Obligations of the Parties:
Both parties are obligated to promptly inform each other about the occurrence and expected
duration of force majeure events.
10.4 Substitute Services:
If certain services are omitted due to force majeure, Havel Sports will endeavor to offer equivalent
substitute services where possible. However, there is no entitlement to such substitute
services.
11. Liability and Limitations of Liability
11.1 Principle of Liability
Havel Sports is only liable for damages caused by intent or gross negligence on the part of
Havel Sports or its legal representatives. In the case of slightly negligent breaches of duty,
Havel Sports is only liable if essential contractual obligations (cardinal obligations) are affected.
11.2 Exclusions of Liability
a) Havel Sports assumes no liability for damages caused by third parties, including damages
caused by catering providers, accommodation operators, transport service providers, or other
subcontractors.
b) Havel Sports is not liable for losses, damages, or accidents that occur during the use of
mediated facilities (e.g., sports facilities, accommodations) unless these are attributable to the
fault of Havel Sports.
c) Participation in sports activities and the use of provided training materials are at the customer’s
own risk.
11.3 Exclusion of Liability for Force Majeure
Havel Sports is not liable for damages or service failures caused by force majeure events (as
defined in Point 10).
11.4 Liability Cap
Havel Sports’ liability is limited, as far as legally permissible, to the total amount of the agreed
contract value.
11.5 Customer’s Duty to Cooperate
The customer is obligated to immediately report recognizable damages or defects to Havel
Sports or the respective service provider to enable damage mitigation. If the customer fails to
make such notification, Havel Sports is exempt from liability, provided that timely notification
could have prevented or mitigated the damage.
11.6 Liability for Personal Items
Havel Sports is not liable for the loss, damage, or theft of participants’ personal items during
the stay unless the loss is due to intent or gross negligence on the part of Havel Sports.
11.7 Liability for Indirect Damages
Havel Sports is not liable for indirect damages or consequential damages, including loss of
profit, business interruptions, or reputational harm, unless these are caused by intentional or
grossly negligent actions of Havel Sports.
